1. Agreement to these terms
These Terms of Service ("Terms") govern your access to and use of the Mountain Quest Academy website, services, and connected programs (collectively, the "Services"). By using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
The Services are operated by Mountain Quest Academy LLC ("we," "us," or "our"). The Mountain Quest family of offerings includes Mountain Quest Trail, FamilyEconomy, and Mountain Quest Acton, each of which may have its own additional terms.
2. Description of services
Mountain Quest Academy provides programs, platforms, and learning experiences designed to help homeschooling families plan, build practical skills, and support learner-driven growth. This website serves as the central introduction to our offerings and may connect you to individual program sites where you can learn more or sign up.
We may change, suspend, or discontinue any part of the Services at any time. We will make reasonable efforts to notify users of significant changes.
3. Accounts and eligibility
To use certain features, you may need to create an account. You must provide accurate, current, and complete information and keep it updated. You are responsible for safeguarding your password and for all activity under your account. If you believe your account has been compromised, contact us immediately.
By creating an account, you represent that you are at least 18 years old or that you have the consent of a parent or legal guardian. Accounts for children must be created and managed by a parent or guardian.
4. User conduct
You agree not to use the Services to:
- Violate any applicable law or regulation.
- Infringe the rights of others, including intellectual property and privacy rights.
- Distribute harmful, abusive, obscene, or harassing content.
- Interfere with the operation of the Services or other users' accounts.
- Attempt to gain unauthorized access to any part of the Services.
- Use automated systems to scrape, harvest, or overload our infrastructure.
5. Intellectual property
All content, materials, and branding on the Services — including text, graphics, logos, images, and software — are owned by Mountain Quest Academy LLC or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may use the content for personal, non-commercial purposes only. You may not reproduce, distribute, modify, or create derivative works without our written permission.
If you submit feedback or suggestions to us, you grant us a perpetual, royalty-free, worldwide license to use and incorporate them into our Services without obligation.
6. Payments and subscriptions
This website does not process payments directly. Payments for Mountain Quest Trail, FamilyEconomy, Mountain Quest Acton, or other programs are handled through each program's own site or enrollment process. Any fees, refunds, billing, or subscription terms are governed by the terms presented at the point of purchase.
7. Disclaimers
The Services are provided "as is" and "as available." We make no warranties, express or implied, about the accuracy, reliability, or completeness of any content. We do not guarantee that the Services will be uninterrupted, error-free, or secure.
Mountain Quest Academy is not a school, accredited institution, or legal substitute for homeschooling compliance in your state. Parents and guardians remain responsible for educational decisions and compliance with local laws.
8. Limitation of liability
To the fullest extent permitted by law, Mountain Quest Academy LLC and its affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or data, arising from your use of or inability to use the Services.
Our total liability for any claim arising under these Terms will not exceed the amount you paid to us in the twelve months preceding the claim, or $100 if you did not make any payment.
9. Indemnification
You agree to indemnify and hold harmless Mountain Quest Academy LLC and its affiliates from any claim, loss, liability, damage, or expense (including reasonable attorneys' fees) arising out of your use of the Services, your content, or your violation of these Terms.
10. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, if you violate these Terms or if we discontinue the Services. You may stop using the Services at any time. Provisions that by their nature should survive termination will survive.
11. Governing law and dispute resolution
These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles. Any dispute arising from these Terms or the Services will be resolved in the state or federal courts located in Wyoming, and you consent to the personal jurisdiction of those courts.
12. Changes to these terms
We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page. Your continued use of the Services after any changes means you accept the updated Terms. If you do not agree to the changes, you must stop using the Services.
